The Illusion of Freedom

Interpol Joins Hunt for Anti-Chemo Mom, Son
By Amy Forliti - NBC Chicago | May 22, 09

Anti Chemo Mom and Son flee

MINNEAPOLIS — Minnesota authorities said Friday they were turning to an international law enforcement agency for help finding a woman and her 13-year-old son on the run from court-ordered cancer treatment for the boy.

Meanwhile, the FBI filed a warrant giving it more legal authority to assist in the search.

The FBI's affidavit says Colleen Hauser left Minnesota on Tuesday with her son, Daniel, a 13-year-old who is refusing chemotherapy to treat his Hodgkin's lymphoma. The affidavit alleges Colleen fled the state to avoid being prosecuted on two state counts of depriving another of custodial or parental rights.

The FBI said the pair flew from Minnesota to Los Angeles on Sun Country Airlines. An airlines spokeswoman said information on passengers, method of payment, and travel companions are confidential.

Interpol, which coordinates police investigations across national borders, was joining the effort to find Colleen and Daniel Hauser.

"We're putting every effort we can into this," said Jason Seidl, a sheriff's deputy in southern Minnesota's Brown County.

The pair were last seen Tuesday morning in southern California, before authorities in Minnesota even realized they had left the state. Investigators suspect they might have headed to one of a number of alternative cancer clinics in northern Mexico.

Doctors say Daniel has a cancerous tumor growing in his chest that's likely to kill him without chemotherapy, but the Hausers prefer natural healing methods inspired by American Indian traditions.

The American Cancer Society estimates there are 35 to 50 clinics in Mexican border towns that attract cancer patients looking for alternatives to traditional U.S. treatment methods. Many of these clinics have offices in the San Diego area that serve as contact points for U.S. patients, who are then referred to clinics in Mexico.

On Thursday, Anthony Hauser appeared before reporters asking his wife to call him and to come home. "If you're out there, please bring Danny home so we can decide as a family what Danny's treatment should be," he said.

Anthony Hauser did not return phone calls seeking comment on Friday.

The Brown County charges of depriving another of custodial or parental rights are listed in a felony arrest warrant that would ease extradition if Colleen Hauser is caught in the United States. The "parental rights" listed in the charges are those of Brown County family services, which has been granted custody of Daniel to get him to a pediatric oncologist.

The federal paperwork filed Friday gives the FBI jurisdiction to assist in finding and arresting Hauser on those state charges.

Authorities have said their options are less clear if the pair is already in Mexico.

At a news conference Thursday, Hoffmann vowed to arrange a safe return for Colleen Hauser without an enforcement action if she shows "a good faith effort to come back."

Philip Elbert, the court-appointed attorney for Daniel, said Friday he hadn't heard from his client.

And people actually have to ask why I say that in the U.S. "We only have the illusion of freedom". Your family, physical body, everything belongs to the State! The sad thing is Americans are so willing to not only do nothing about it but continue to grant Government absolute power. Frustrated

What a shame. They should have nothing to run from and be free to travel, without interference wherever they wish.

Period.

"The 'parental rights' listed in the charges are those of Brown County family services, which has been granted custody of Daniel to get him to a pediatric oncologist."

The state has a natural right of parens patriae used to make abandoned, abused and neglected children, incompetents, and so on wards of the state. The county probably got it through statutory law.

Of course, the very idea a government entity -- here a municipality, not the state -- can take your child away is outrageous if it wasn't so common. The legal definitions of how and when a child can be removed from the family has expanded to ridiculous grounds. And the worst part is for them it's just another day at the office, as if taking your child was such a small thing. All Hail the Family Gestapo!

I've worked on the periphery of several cases of this type and they are tragedies the kids -- hell, entire families -- never seem to get over. Custody of a raped little girl won't be given to her guilt-free dad because the state and county throws squads of lawyers, caseworkers and other parasites at the court in a frenzy to protect mother-only custody. A three year old girl was seized with her sisters on suspicion of her parents being hippies then stripped and subjected to a pelvic exam at the local hospital. When she ran naked into the hall screaming for help other adults caught her and strapped her down so the exam could be finished. Oh, it just goes on and on, everywhere.

If anyone had touched my daughter when she was young -- well, I'd probably still be in prison.

I read about that case and it stunk to high heaven. The absolute powers of the states and how they use them violate the very essence of every civil right on which the constitution was created. What you said was true, and many Amber alerts have been instituted on such situations. And we're all supposed to believe its in the child's interest.

Sad indeed.

Yet another example of a good intention gone bad! People and yes even minors should have the right to refuse treatments based on religious, moral or personal beliefs. Government should be responsible for all costs of treatment in such situations, I would venture to bet we would then see less of this involement in personal health issues! Oh right that is what Universal Health care is about to do!

Sadly I am sure the system will bill and eventually bankrupt his family, mostly because this is the american way. It seems to be a no win situation, had they actually attempted to do the chemo I am sure the health system would have found ways to deny parts of the treatment that would have meant the difference between life and death.

Hhmm, you think the parents have the right to let their child die on this cancer?

Because this would be the resolution, if they take the child with them and do not bring it to the chemotherapy on a long term.
This would be like ´belonging´to someone in ´slavery times´.

What would the child say? Everybody ever asked it, if it wants to stay alive?

Read the story, the decision was made as a family.  And as a question of the decision, it's up to the family, the government has no business interfering.

Yes, I read the story and I read it twice. Because I do not believe that a 13 year old is not influenced in such a decision by his parents.

Who -as a child- would speak against the parents?

Would you have done this?

I do not think a child would do it. That is why I do not trust the story of "we-as a family".

The father is asking the mother and the son to come back and think about a solution of "we as a family".

I see no "we-as a family " here.

So you think that the State should be the Parent?

It's simple, the State nor anybody else has any business butting in.  What you believe is right they may believe is wrong and what they may believe is right you may believe is wrong.  People have the right to decide their path/destiny, it's no bodies business what so ever period.
