Dept. Of Justice Drops New Black Panthers Case

Obama Administration Abandons Voter Intimidation Lawsuit

Sources told The Bulletin that there is internal dissension in the Department of Justice (DOJ) about a voter intimidation case from last year’s presidential election. Obama appointees did not want to proceed with the case, while the career prosecutors did. The incident occurred in Philadelphia and involved the New Black Panther Party for Self-Defense (NBPPSD).

The DOJ filed a lawsuit under the Voting Rights Act against the NBPPSD and three of its members alleging the defendants intimidated Philadelphia voters during the Nov. 4, 2008 general election. The action was filed in January before President George W. Bush left office.

The complaint, filed in the United States District Court in Philadelphia, alleged that on Election Day, Nov. 4, 2008 in Philadelphia, NBPPSD members Samir Shabazz and Jerry Jackson were stationed at the entrance to a polling location at 1221 Fairmount Avenue, wearing the uniform of the organization. It also states Mr. Shabazz repeatedly brandished a “police-style baton weapon.”

The complaint said NBPPSD Chairman Malik Zulu Shabazz confirmed that the placement of Messrs. Shabazz and Jackson was part of a nationwide effort to deploy NBPPSD members at polling locations on Election Day. The Justice Department sought an injunction to prevent any similar future actions by NBPPSD members at polling locations.

“Intimidation outside of a polling place is contrary to the democratic process,” said Acting Assistant Attorney General Grace Chung Becker at the time. “The Department takes allegations of voter intimidation seriously.”

None of the defendants responded to the lawsuit. Instead of immediately filing for a default judgment as is the normal procedure, sources told The Bulletin the DOJ asked for and received an order from the court providing an extension of time to file. Specifically, they asked the court to give them until May 15.

But on May 15, DOJ changed its mind again. Rather than a default judgment, the DOJ filed a notice of voluntary dismissal of the lawsuit for two of the defendants. This included Mr. Jackson, who identified himself to police as a member of the Democratic Committee in the 14th Ward. He also produced credentials to that effect.

DOJ only asked for a default judgment against one defendant, Samir Shabazz, which was granted on May 18. But sources say the proposed order for the default judgment asks for none of the usual conditions the Justice Department would want, such as keeping Mr. Shabazz away from any polling locations for a set number of years into the future.

Hans von Spakovsky is a former career Counsel to the Assistant Attorney General for Civil Rights. He thinks the inaction by the Justice Department is unprecedented. He told The Bulletin that the dismissal by Justice, with no notice on the Justice Department press site, particularly against an organization listed as a hate group by the Southern Poverty Law Center, is a horrible miscarriage of justice. He said DOJ has failed in its duty to enforce voting laws. He is outraged by the action.

“It is absolutely unprecedented for the Justice Department to dismiss a lawsuit after the defendants failed to answer the suit and are thus in default," he said.

Mr. von Spakovsky said that the NBPPSD's lack of response was the legal equivalent of an admission of all theallegations made about the defendants’ organized effort to threaten and intimidate voters.

"And dismissing an individual who was a local Democratic party official who defaulted by not answering the complaint smacks of the worst sort of political partisanship," he said. "It is completely contrary to all of the promises that Eric Holder made when he was confirmed to be Attorney General.”

Vito F. Canuso, chairman of the Philadelphia Republican City Committee, said that what the Justice Department did is tantamount to filing a lawsuit for $100,000. Then when they win the suit for $100,000 they ask for $10,000.

For some reason this issue I missed totally! All I can say about it is WHAT THE FUCK!

In the spirit of full disclosure (unlike Obama) I am no fan of Eric Holder or Obama. This whole issue needs to be vetted publicly and deserves a proper response from DOJ and the White House IMO.

Screw the "teaching opportunity" at the white house today with Gates, Crowley and Obama. How about including this in the news coverage too!

This is IMO blatant racism and favoritism being displayed. Just another ripe example of where this President and his administration is coming from. Voter intimidation is an assault on all of us citizens. When there is proof and somebody is convicted accordingly then implement the punishment regardless of skin pigmentation!

It is the blatant disregard of the "Rule of Law" that pisses me off and this incident gives me pause to reconsider where I stand when it comes to fairness in race relations!

Would this have been the same outcome had the guys been "Skin Heads"? This makes me more than just angry and maybe it is time we whites begin to push back a bit on all the political correctness and stop apologizing!

It is shit like this that will destroy any advances we have made as a nation regarding racism.

I am one pissed off white dude at the moment.

Any form of voter intimidation, and I mean even as much as a nasty look at someone voting conservative, should be met with a lengthly jail sentence, massive fines, and being permanently stripped of your right to vote. America was built on democracy, and to sway a fair election system where votes are counted is about as unamerican as you can get.

There was an issue a while ago where people passed out pamphlets to say that the voting for one party was on the usual election date, and that the other was after it. Also, signs were getting stolen, cars in a voting place had their tires slashed, and some people were assaulted or had windows smashed because of who they supported. Some democracy this is, don't worry about the government, fear the public instead.

Makes me embarassed to say I'm an American citizen, I'm seriously considering going back to the UK where this shit isn't as big a problem. Those guys need to hang high for messing with the vote. It's treason that's what it is.

Interesting here we are a year later and this issue is once again in the news - well some of the people are covering this story.

Now I wonder after watching that fucking idiot King Zulu BooBoo Buttshit using the word "CRACKER" and then encouraging genocide of the white babies why again is it that I can't use the word "peasant " to define him?  Why is it that the DOJ is in fact acting in a Racist manner and nobody is screaming for Holders head on a platter? 

This administration has done more damage to race relations than Wilson ever did.  Stop fucking with the language in a weak attempt to redefine our world.  A Muslim Terrorist is just that, and a peasant is a peasant . just like a skank whore is a skank whore or a Rose is Rose by any other name!

I have to agree here. Everybody got bent out of shape with what happened in FLA in 2000. What is fair is fair. And the "integrity" of our voting system has now officially become a joke because of this.

 

Politics has no place here. Period.

Our voting facilities are sacrosanct - regardless of race, creed or color and yes even sexual orientation one should never feel intimidated while fulfilling their duty as a citizen!

Now my next question is when are white people going to claim "CRACKER" as an offensive term like "peasant " and then demand/claim that only whites have exclusive usage privileges of the word?

I find the label "New Black Panthers" to indicate an new era of bigotry and racism is being promoted.  These nut-bags need to be either eliminated or dealt with swiftly to prevent further erosion between the races here in America.  The NAACP is another fucking group who survives only by playing the racial victimization card in an attempt to justify their relevancy.  These groups are the equivilancy to the Klu Klux Klan!  Is there any real value in allowing them to spew their hatred?
